Terms and Conditions of Use

By using the Confluity website, the Simplified Projects Model, the Moves Library, or the SuccessFactors Navigator app, you agree to these Terms and Conditions. If you do not agree, you must stop using these services.
These Terms apply to:
- www.confluity.co.uk
- The Simplified Projects Model
- The Moves Library
- The SuccessFactors Navigator app
- All free and paid tools, resources and coaching provided by Confluity Limited
Your continued use of any of these services indicates your acceptance of these Terms.
Other documents that apply to your use of our services are:
1. Definitions
In these Terms:
- “Confluity”, “we”, “us”, “our” means Confluity Limited.
- “Services” means the website, the Simplified Projects Model, the Moves Library, the SuccessFactors Navigator app, and all free and paid tools, downloads and coaching provided by Confluity.
- “User”, “you” means any person or organisation using our Services.
- “Content” means all text, templates, tools, images, audio, video, data, code, frameworks and other materials provided by Confluity.

3. Access to Our Services
- Access may include free pages, email sign up content, subscription areas and account only tools.
- It is your responsibility to make the arrangements needed to access the Services.
- Access is provided on an “as is” and “as available” basis. We do not guarantee that the Services will always be available or uninterrupted.
- We may change, suspend or discontinue any part of the Services at any time.
- The Services are aimed at business and professional users. They are not directed at children.
4. Use of the Simplified Projects Model
You may use the Simplified Projects Model as follows:
- For your own work.
- Within your organisation.
- As a consultancy or professional stating that you use the Simplified Projects Model, provided you do not claim to own it.
You must not:
- Copy, republish or redistribute the model outside your organisation.
- Sell, licence or repackage the model as your own product or framework.
- Create competing products or frameworks that are based on or derived from the Simplified Projects Model.
- Remove Confluity branding or attribution from the model.
5. Use of the Moves Library
The Moves Library is a paid resource available to subscribers.
Subject to a valid subscription, you may:
- Use the Moves Library personally.
- Use it within your organisation.
- Use it in client work, including as part of your own services, as long as your subscription is active and you comply with these Terms.
You must not:
- Copy, resell, republish or redistribute the Moves Library content outside your organisation.
- Create derivative templates, plays or libraries based on the Moves Library for separate sale or distribution.
- Include the Moves Library in a commercial training product or software product in a way that makes it appear to be your own IP.
- Sell access to the Moves Library without paying Confluity the required licence or subscription fees.
6. Use of the SuccessFactors Navigator App
The SuccessFactors Navigator app is provided as an online tool to help you assess and record project readiness and Success Factors.
You may:
- Use the app for your own projects.
- Use it within your organisation.
- Use it as a consultancy tool, provided you clearly state that you are using Confluity’s SuccessFactors Navigator app and do not claim it as your own product.
- Use generated scores, reports and outputs for your internal business needs and client work.
You must not:
- Claim that the SuccessFactors Navigator app is your own software or intellectual property.
- Reverse engineer, replicate or attempt to reproduce the app or its scoring logic to create a competing tool.
- Use automated tools to scrape or extract data from the app.
- Upload any unlawful, harmful, offensive or infringing content into the app.
7. Paid Services and Subscriptions
We offer the following paid services (names and details may be updated on the site from time to time):
- Simplified Projects: Core – subscription access to the Moves Library, templates, online tools and the SuccessFactors Navigator app.
- Simplified Projects: Organisation – subscription organisation level access, including tools, templates, setup support and a set number of licences.
- Coaching and Support – one off or bulk purchase coaching sessions with Greg Krawczyk or another Confluity coach.
Prices and features for each service are shown on the site and may change from time to time.
7.1 Payments and renewals
- Payments are processed via MemberPress and Stripe or any replacement payment processor we choose.
- Subscription services renew automatically at the end of each billing period (monthly or annual) unless you cancel before renewal.
- One off and bulk purchases are paid at the point of sale and do not auto renew.
7.2 Refunds
All payments are non refundable except where a refund is required by law. Confluity may choose to offer refunds on a discretionary basis, but is not obliged to do so.
8. Free Trials and Promotions
We may offer free trials or introductory access periods for some services.
- Any trial period, price and conditions will be set out at the point of sign up.
- Unless stated otherwise, trials convert to a paid subscription at the end of the trial period unless you cancel before renewal.
- Trial availability, duration and eligibility are at our discretion.
- We may modify or withdraw trial offers at any time.
- We may limit trials to one per user or organisation.
9. Acceptable Use
You must use the Services in a lawful and reasonable way. You agree not to:
- Copy, scrape, harvest or download content from the website, the Simplified Projects Model, the Moves Library or the SuccessFactors Navigator, except as allowed under these Terms.
- Share your login details with anyone else or allow others to access your account.
- Resell or bundle our tools in a way that misrepresents our IP as your own or avoids paying the correct licence fees.
- Reverse engineer, decompile, disassemble or attempt to derive the source code or scoring logic of the SuccessFactors Navigator app.
- Create derivative versions of the Moves Library or templates for separate sale or distribution.
- Use automated tools or scripts to extract data from our site or app.
- Upload any harmful code, malware or other content that could damage the Services or other users.
- Attempt to bypass security controls, probe for vulnerabilities or interfere with the proper operation of the Services.
10. Intellectual Property
All intellectual property rights in the Services and Content are owned by or licensed to Confluity. This includes the Simplified Projects Model, the Moves Library, the SuccessFactors Navigator app, and all related tools and materials.
You may:
- Access and view the Services in a web browser.
- Print or download extracts for your own personal or internal business use, within the scope of the licences above.
You must not:
- Modify printed or downloaded extracts.
- Remove our branding, copyright notices or attributions.
- Use Content for any commercial purpose outside the scope of the licences granted in these Terms without our written consent.
11. Data Ownership and Anonymised Data Use
You own the project data and information you input into the SuccessFactors Navigator and any other tools we provide. Confluity owns the underlying platform, tools, structure and scoring logic.
Confluity collects, processes and stores project and performance data to improve its services. We may use anonymised and aggregated data for:
- Internal analysis.
- Improving our methods and tools.
- Industry reports, insights and benchmarking studies.
All such data is anonymised and aggregated so that no individual or client is identifiable. Clients in sensitive sectors (for example defence or intelligence) are excluded from data aggregation by default unless they explicitly opt in.
You may opt out of anonymised data processing at any time by contacting us in writing. Opt out requests apply to future processing and do not affect anonymised data already created.
All personal data is handled in line with UK GDPR and our Privacy Policy, which you can find at https://confluity.co.uk/privacy-policy/.
12. User Accounts and Security
When you create an account, you agree to:
- Provide accurate and complete information.
- Keep your details up to date.
- Keep your login details confidential and not share them with others.
- Tell us promptly if you believe your account has been accessed without your permission.
If you cancel a subscription, access to the relevant paid features will continue until the end of the current billing period and then end.
13. Suspension and Termination
We may suspend or terminate your access to some or all of the Services if:
- You breach these Terms.
- Your payment fails or is reversed and you do not resolve it promptly.
- We detect misuse, scraping, sharing of logins or other abusive behaviour.
- We decide to discontinue or change part of the Services.
If your access ends, we will retain anonymised and aggregated data only, as described in section 11.
14. No Professional Advice
The Services provide general information and guidance only. They do not provide professional, legal, financial, accounting, governance or compliance advice.
You remain responsible for your own decisions and for seeking appropriate professional advice where needed.
15. Limitation of Liability
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Any other liability that cannot be limited or excluded by law.
To the fullest extent permitted by law, all other liability is limited to the total amount you have paid to Confluity for the Services in the twelve (12) months before the event giving rise to the claim.
We are not liable for:
- Loss of profits, revenue, business or anticipated savings.
- Project delays, failures or overruns.
- Loss of data caused by your actions or failures.
- Any indirect, special or consequential loss or damage.
- Outages, errors or failures caused by third party providers such as hosting, Bubble, MemberPress or Stripe.
16. Third Party Services
The Services depend on third party providers, for example hosting, Bubble, MemberPress, Stripe, email and analytics.
- You may also be subject to the terms and conditions of those third parties.
- We are not responsible for their performance, availability or changes to their services.
- We may change third party providers at any time.
17. Changes to the Services and to These Terms
We may from time to time:
- Update or modify the Simplified Projects Model.
- Add, change or retire tools, templates or Moves.
- Update or release new versions of the SuccessFactors Navigator app.
- Change subscription prices or billing terms.
We will take reasonable steps to notify you of material changes that affect paid subscriptions, for example by email or a notice on the site. Your continued use of the Services after changes take effect means you accept the updated Terms.
18. How We Use Your Personal Information
We will only use your personal information as set out in our Privacy Policy and Cookie Policy.
19. Communications from Us
- We may send you important notices about the Services or these Terms by email.
- We will only send you marketing emails where we have a lawful basis to do so. You can opt out of marketing at any time by using the unsubscribe link or by contacting us.
20. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them are governed by the law of England and Wales.
The courts of England and Wales have exclusive jurisdiction over any dispute or claim relating to these Terms or the Services.
